The genesis of this convention used to be on a quay of the port of Bergen in March 1985. Ragnar Amason advised to Phil Neher a small, mid-Atlantic convention on fresh advancements in fishery administration. within the occasion, greater than twenty papers have been scheduled and over 100 and fifty conferees have been registered. Logistical problems have been taken care of via for a summer season 1988 convention in Iceland. The particularly cutting edge administration courses have been within the South Pacific; Aus tralia and New Zealand had brought person Transferable Quotas (ITQs); and Iceland, Norway and Canada have been additionally experimenting with quotas. It appeared to this system committee (Rognvaldur Hannesson and Geoffrey Waugh have been quickly on board) that those quotas had roughly features of estate rights. estate rights have been additionally taking different kinds in different places (time and quarter licenses, restrictive licensing of vessels and equipment, conventional use rights). the assumption of rights dependent fishing grew to become the subject matter of the conference.

A second effect of a quota system is the removal of incentives for racing behaviour. Ideally, when fishermen are on quotas, they have every incentive to set their own pace in taking their quotas, on different days, with different boat speeds and sizes. Far from being a racetrack under close official supervision, a fishery may take on the appearance of a peaceful common rangeland, with the owners replacing fishery wardens in checking on each other. This substitution depends, however, on the certainty of TACs.
Eventually some 17 For forward-looking rationalisations of proposed regulations, see Sol Sinclair, in Hamlisch (1962); and Pearse (1979a and 1979b). Some history in one country is to be found in Scott and Neher (1981), and across-country comparisons are in Rettig (1984). 18 That is, few that I know of. Campbell, writing of Bay of Fundy herring rights, and other authors of the papers contributed to the Scott and Neher report, do touch on this theme (see Scott and Neher 1981, final Chapter). 19 There might be an incentive in a small fishery, in which, by definition, the owner of one vessel could change the size of the stock appreciably.
A related question, about whether politics and the courts will give an individual rights system a chance to substitutute for government regulation, is taken up later. 30 Of course, private quotas are only harvesting rights. They apply only after a T AC has been set. Thus a quota system cannot dispense with some outside means of determining each year's TAC. Neither can they take over other aspects of managing the fishstock and its predators and preys; nor of protecting its environment. This requires sole ownership, or perhaps the communal and TURF fisheries de- 30 In the longer conference paper from which this derived, I attempted to sustain a complex comparison of the dependence of limited licensing with that of quotas, on government management and regulation.
